I can now report that after standing my ground, makeing legal threats and promising removal of body parts orange has agreed to waive the £100 emergency insurance fee, add insurance to the account and replace the handset  |

My p800 says "Smartphone" on a factory sticker on the box, BUT if you buy a phone (many adverts for the p800 just call it a phone, inc Orange) & you pay for insurance on your contract, then you are within your rights to claim on that insurance provided;
Thats if you GENUINELY believed that you are paying for insurance on that handset & that you were NOT told (Verbally or in writing) that it wasn't covered.
It is against your consumer rights to refuse your claim if you were being sold insurance for a device you bought in good faith & that you beleived to be a mobile phone. EVEN if it says "No smartphones" in the small print, because its all about WHAT YOU WERE LED TO BELIEVE ! |

thats my point i was told thatbit was not cover and needed to be insured seperatly.. i agreed the cost of the insurance.. the just did not set up the insurance as requested.. hence no cover! |

@searley, if you applied for the insurance & beleived you were paying (Or GOING to pay for it) then as far as you are concerned you were insured.
Many claims on car insurance happen before a payment is made on the policy (Within the first month or during the "Cover note" period) but the insurers are still expected to pay out & quite rightly.

This is why i was so angry at orange when the attitude was 'you are not covered' it was basically a screw you, not our problem attitude you can either pay £100 emergency cover or £300 emercgency replacement.
My anger was based on i beleived i was covered and should have a replacement handset in 24hrs... instead i had to make threats and be persistent.. for 4 days!

I honestly believe Orange give their staff the power to "Bend" or "Straighten" the rules according to the customer, more than other networks, because it seems with Orange you get as many different answers as people you speak to.
So the rule is, when having a dispute over something with Orange UK, keep asking different people until you get satisfaction.
The nice thing about them is that they are there for you 24hrs a day, which takes some beating.
