Same problem again as with the K700i? lmao.. all my phones are from o2 but ive never had any bother yet.. I must be lucky ;-)

Well....after 2 weeks of effort...8 telephone calls....2 visits to an O2 store....2 20 minute standing arguments with the store staff i have got rid of my K750i and contract
I am seriously considering ever buying from O2 again....definitely NEVER from an O2 store on high-street they are the most unhelpfull...inconsistant...misleading people i have ever had the lack of pleasure to meet
O2 customer services have been helpfull and understanding ... O2 store staff have been misleading and obstructive
I won't go into the whole time-line of my complaint but suffice to say i even had to resort to contacting citizens advice to get legal confirmation of my position. Even pointing this out to O2 store staff inc management i had eventually to let O2 customer services sort it out which they did in the end but its been a frustrating, upsetting and timewasting process....normally i am a very polite and patient person but these people have made me just so angry....
O2 .... You should sort out your store staff and get them to understand their own rules |

with regards to using it in a car gr33g0, you do know it is illegal to drive and talk at the same time. use a jbluetooth headset...perfect |

my k750i has started playin up already, apparently from o2's "new tested batch", havent even had it a week yet pity, its a great fone otherwise

I'm sorry to hear about your past with o2, how long have you been with them btw? is this your first contract?
I think cos ive been with them for several yrs they want me to remain so they sell me good SE's lol
only crappy phone ive had bother with was that bloody shitty MOTOROLA V600 last yr
o2 are the best network for me, I can't see another network outhere that would offer me what im on atm
btw im with o2 online...

I have been with O2 for 11 years (formally BT Cellnet)
However, i think i will be switching this year....for more reasons than just this latest incident....
I have always found them to be reasonable in the past...cheap and reliable .... just the O2 store on Clumber street in nottingham has the most unhelpful and rude staff i have ever met....
When i didn't leave after ten minutes of heated discussion with a staff member the manager came out ... looked at me and made the expression "oh god he's still here"
I will never again darken their store with me presence and O2 can count me as a former customer as i won't be renewing my contract again |

i think o2 are really good i had no problem with support the only trouble with the 750i but i can dismiss that as i have the phone now and it works really well and they have given me a really good deal 200 minute xnet and 500 text and a k750 FOC for £15 a month what more can i want!! |

It all boils down to a simple single fact that the O2 manager WOULD NOT accept even though O2 terminations and the Citizens advice said this was the law....
Basically...the phone was purchased....the phone was faulty....O2 after 3 weeks of trying were unable to ether repair or replace the phone ... therefore the terms of the contract i signed had not been fullfilled on their part ... therefore i could withdraw from the contract on those grounds...
O2 manager just kept repeating that they could replace the phone but that would have been on the 28th day and no guarantees (as we have seen that it would be fault free) and that it was after the 14 day cooling-off period allowed ....
I just kept saying that the cooling-off period didn't yet apply as the terms of the contract had not been fullfilled in order for me to fully utilitise O2s services therefore the contract had not yet come into force allowing me to return the phone and cancel it.....
He just wouldn't or couldn't get his head round at and just point blank refused....
I ain't no legal expert but i think i can understand these points pretty simply...i was almost ready to consider getting proper legal advice and getting a letter or something to get his thick head round it

Did you return the phone within 2 weeks ? If not you can't hold them responsible ! After all they are only resellers ! You could have initiated a claim against SE (the manufacturer) after all they've caused all this mess.If the original damage should have been caused/done by the retailer then you could have had a 'direct' claim.Remember one thing : is you who wanted that item.You went out of your 'own will' to the shop to buy it ! You knew the item is new on the market and that the company (SE) has in the past supplied 'faulty' devices ! On the other hand if you returned the cell within 2weeks then the retailer is legally binded to sort the matter out to your complet satisfaction (take the item back)

I'm not gonna post anything further on this matter after this as the matter is now closed and sorted but just some final thoughts in response
I did want the phone....i went out of my own free will and entered into an agreement with a company to supply goods and services
The "goods" quality and faults prevented me from using 100% of the services provided in the contract....
Initially i had 3 choices when i contacted O2 about the fault (48 hours after buying the K750i and yes i do know about SE's faults in the past ... had SE phones for years and ericsson phones before that)
1. Exchange the phone for a different model (since i have S700i and K700i i didn't see an equivalent product to make this viable)
2. Waitfor new models to come in
3. Cancel contract
I chose to wait for a new model without faults....
I have waited over 3 weeks for them to provide me with goods up to the standard expected and required by them....
The claim is always with the person making the sale...if your car breaks down you take it to the dealer/reseller....you don't drive to the manufactures head office to take it back
O2 have been unable to provide a quality replacement within 25 days and couldn't assure me 100% that they could provide me with a 100% working product within 28days....
So i chose to withdraw from the contract since they have been unable to honour the terms of that agreement....the 14days cooling off period is provided in law for the purposes of "changing ones mind" ... in this case it is the resellers inablity to provide the goods and services required by them under the terms of the contract
This is the position O2 online take...had i got the phone from them they wouldn't have hesitated to take the handset back without problem...they wished they could but were unable as O2 online is not the same reseller as O2 retail...it wasn't their product to take back
A complain is ALWAYS with the vendor not the manufacturer....even if the phone broke down 11 months 27 days after i bought it ... i would still take the phone to the store i bought it from for them to send it back for repair
My reasons for leaving O2 are not 100% attributable to this incidient...i will be leaving for another network when a certain product of that network becomes available shortly as it would save me £100's ... I don't like nor did i enjoy having to cause a scene in public...i didn't appreciate the manner in which i was addressed or dealt with and comments made within my earshot were not what i would expect to hear so my main beef is with the 2 members of staff that dealt with this not O2 ....
O2 customer services were doing as much as they could to help and support my problem and were 100% behind me on it....this 1 store just wouldn't accept what their own company was telling it .... for whatever reason i couldn't say
All i am saying is that i won't ever buy a phone from a retail store...i will in future go to the online direct vendor as they seem much better setup and capable of acting in a professional, courteous and respectfull manner....

Hi,
I got ome of the 'new' batch from O2 a week ago. I have been very impresssed with the phone and the camera is outstanding, however the phone seems to crash all the time, I can be playing a game and the phone will reset itself! I've just looked at the firmware and it's the following:
R1A044
Is this the latest frimware? Has anyone else has any problems from the 'new' batch. Should I contact O2 and get a replacement?

This is the original firmware that some people have issues with, R1J or R1L is the newer one I think. You can (i think) update it on SE website. |
