Remember these phones have the same name and therefore should be the same inside!Differences in hardware can exist BUT,as SE SPONTANEOUSLY PROMISED,THEY WILL BE THE SAME.But again,SE only wrote it on the last small page on the site and changed the date without any further explanation about what sort of problems they encountered.It is normal that,under those circumstances,customers get angry!

I think the point about taking this to watchdog is good and ture. But who is going to lead us, and also the point about taking your phone back to were you bought it from is also true, "IT DOES NOT DO WHAT IT SAYS ON THE BOX" so there for by law they must change it or give us our money back.

Where on the box of the T68m does it say its mms supportive, unfortunetly there not doing anything ilegal. They told us it would be but didnt put anything to paper. If any1 has e-mail's or letters from SE sayin that it will be done by a certain date then it shud be and id get in touch with them either asking for a replacement T68i or the software.
Sum1 put a link on here 4 a SE e-mail address page I dont know how u do it. Then every1 will bombard them with e-mails. Even if they only say 'SORT OUT THE T68M SOFTWARE'. |

Before the launch of new SonyEricsson.com website Ericsson.com have publish an article about MMS they use T68m as the MMS demonstration in that article. They stated that they will release the upgrade software for T68m to make it MMS capable once the MMS was supported by the operator. |

I can see people's point of view with respect to the upgrade being released, but this does not make the phone unfit for purpose.
As a someone who is 3 months from being called to the English Bar and a part-time mobile phone salesperson, here is my take on matters.
FIT FOR PURPOSE

If you bought a T68m, regardless of whether you were promised a T68i upgrade - the law will deem fitness for purpose based on the product you were sold. Everyone's t68m is probably fit for the purpose they bought it for.
So their is probably no remedy on this basis.
CONDITIONS AND WARRANTIES
------------------------------
When a representation is made to you, such as "the t68i upgrade will be available in week 21" the law deems it either a condition or warranty. (For completeness, there are intermediate terms, but we will ignore them here).
A representation is a condition if it goes to the heart of the contract. Now, whilst most of you will argue that this representation went to the heart of the contract, its unlikely, based on case law that a court will find this so.
This representation is more likely to be deemed a warranty, it was a term made in the course of dealings and unlikely to be deemed as inducing the contract.
The main difference is that where a condition is broken, you can repudiate (end) the contract, whereas a breach of warranty only attracts damages (money).
The amount of damages that you would receive for not having mms would be nominal.
Remember too, when you buy a phone from a retailer with a contract or as a prepay, there are actually two contracts being performed, one for the phone and one with the network. Breaches on one, will not affect the other. Even if you managed to repudiate the phone contract, you would still be liable for your commitment with your network.
The bottom line is that you are unlikely to get much from your retailer. I know that my employer is now offering t68i upgrades and so will simply send your phone to the local service centre.
Caveat: This information does not purport to be exhaustive and is purely my legal opinion. No liability will acrue on my part for your reliance on it. Further, this is my statement on the law as it stands in England and Wales only.

It's the first time SE answers politly to us,if we trust this email,the upgrade is here but our regional SE are taking their time convincing networks for MMS,hope we will not have to wait that MMS is supported by networks before having the upgrade,it could take monthes
