also, the store will just tell you it is cosmetic and doesnt affect the operation of the fone, also you will need to proove it was like that when you got it.

No offence, by why would you want to use car polish to polish the handset up?

I've checked some terms and conditions that should be applicable to most phones and found this statement:

You must take reasonable care of your phone. In circrumstances where there is reason to believe you may not have done so your claim may not be reffered to a lass adjuster and no replacement will be issued unless he/she confirms your claims.

I think your claim would be excluded where damage relates to:
- Cosmetic damage
- Failure to take reasonable care
