MP3 Format, settings etc for K700 |

I have the Voda branded SEK700 and am currently awaiting upgrade to R2V001 from R2N001.
I have made some MP3s for ringtones and sent them to the phone and they play but despite DRM'ing them they can't be used as ringtones till I do the upgrade... What I want to know is about the other critical format issues for MP3 playing as ringtone on the K700.
The manual says:

The ringtones in MP3 format I have made are playable on the phone but not able to be assigned to the ringtone. Does this mean that once the firmware is correct and they are DRM'd they will be ok?
ie is the 16kHz thing refering to WAVs only? I looked at my MP3 software and don't think I can set the kHz on the Kbps...

I have searched and am still confused about sample rates and what applies to which formats...
