With the rapidly increase of speed of data transmission in the networks of the third generation, a commercial sector that was encouraged immediately was the industry of pornographic material. The continuously increase of storage capabilities, in combination with the coloured screens, the reproduction of video and sound and the most rapid mission and reception of data, changed the mobile telephone not only into a game machine, but also into a device of reproduction of pornographic material. It appears that this... "industry" struck for good the Chinese market, so the highest court of China, announced a new law regarding the production, publication, republication, sale and distribution of pornographic material via the Internet, the appliances of mobile telephony, and constant telephony. According with the new amendment, (6 September 2004), any person who is involved to produce and distribute electronic pornographic material will be treated by the legal system with the same way as it is involved in printed pornographic material. Up to now, the legislation of China did not have any concrete law for the confrontation of electronic pornographic trade.
The new law, sets a sentence of imprisonment from three years until life imprisonment depending on the case. That is to say, for the cases where the person is accused for transmitting at least 200 written messages, or at least 100 sound messages with pornografic content, then the sentence of imprisonment is three years. For cases where at least 10000 written messages, or 2500 sound messages have been send, then the sentence will be life imprisonment. Same treatment for the holders of web pages that pornographic material is displayed. For a such page that accepts at least 10000 visits, the sentence of imprisonment will be three years, while if it is a page with much bigger movement, that is to say with visits that exceed the 250000, then once again the face sentence will be life imprisonment.
