Evidence of what ??? They can't prove that it was you, so it's their word against you .... Nothing that they can do much and I'm sure car parkings have videos so you can prove ( if necessary ) that you are not the faulty one.

Even if someone attacks you, you cant defend yourself with a greater level of force than they use. So if someone attacks me and i do one of me tae kwon do moves and mess them up, then i'm liable for assault. Just as if someone pulled a knife on you blew the f**kers head off with a shotgun, you would still be liable. Unfortunately



edit:BTW good to hear you kickeed their asses. That's always fun to do, hope you gave em an extra few hits while they were down

Best thing you can do is ask your local CAB for an advisor or get a lawyer cos you wont have to pay.

this is wat those porker fuc*s (cops) told me. My friends dad is a layer and hes hookin me up with some free legal stuff! Neway not goin to court yet, still at police lvl

i knew some rich kid who had a P9. and hes like 12. I couldnt belive it...i mean he doesnt know how much stuff the phone can do, he just got it cos its expensive...quite annoying acually.

Anyway..heres the story. Hes walking down the street and two apparently hench (tonk, built, buff..whatever u wanna call it) guys come up to him. He has his P9 in his hand. They say
"Gimme ur phone.."
*awkward silence*
and the kid replies
"NO! gimme YOUR phone" (he's like 4"10 tall)


*hench guy takes it outta his hand and legs it*

Furthermore there has been a case in England where a sign saying "No Gypsies" was held to breach the Race Relations Act, so again yes.

Whether Gypsies constitute a race or not, I wholly agree with Doink, the bigotry in this thread is sickening. I don't care whether you call it racism or bigotry, it's uncalled for.

Whoever stole this boy's phone deserve a spell in one of Her Majesty's fine hostels but I don't care whether they are white, black, gypsies or whatever.

Here I go on my amateur lawyer bit again...

It's not strictly true that you cannot use greater force than they do. The law says you can only use "reasonable force".

Exactly what constitutes reasonable force clearly varies from case to case, but in general it's the minimum you can get away with in the situation. If you are tiny and attacked by three big men armed with knives, you'd almost certainly get away with shooting them.

The problem in this case is that more force than appeared to have been necessary was used. I'm not saying that it was wrong to have kicked them in the head (in fact I wish I'd seen it), but there has to be an element of proportionality about your response.

Your best bet is probably to claim you were frightened and because of that over-reacted. If you claim you kicked out to protect yourself and didn't have time to think of the consequences, it might help. Whatever you do don't say they deserved a kicking (which they probably did) so you gave it to them.
