All my stuff stolen from my school locker. Any rights? |

Hi all,
Not in the best of moods at the moment because either yesterday, or today, my school locker (which we have to pay for) was forced open. The school don't really give one so I'm off to the head tomorrow and if we can't come to an agreement (which I know for a fact we won't) then I'll get my mum involved. We pay £5 a year or £20 for all the time were at the school for the lockers and the video camera is there, but facing down a corridor, when it could be easily turned towards the lockers and the one's who did it would be busted now.
Do I have ANY rights at all, I'm thinking I should because we paid for the facility?

Yes of course you do have rights. At the end of the day you pay for the locker and property was stolen on their premises. What was taken?

Forgot to say, my PE kit, which may not sound like much, but totals up to £70 ish.
What rights do I have then, do you know bono?
EDIT: and the only reason I dont think I do is because my mate had over £300 of stuff stolen and they said we can't claim on our insurance because it is less than £2000 value

Not sure of your full rights but if its something thats locked up on their premises then yes i think you should have a case. It would different if it was left lying around and stolen. Its like for instance at the hotel i work at if guests lock something away on the hotel grounds like in a safe and its stolen they have rights to compensation of some sorts. Though not sure if it will be easy to prove with no camera facing the right way. You need to point that out to them. If the locker is damaged too makes things easier but i doubt they will finger print every one there. Is there anyone who you dont get on with?

This is what I thought, no not really. At the end of the day, the camera should be facing the lockers and everyone should keep their own stuff to themselves, and like me, if you want something, go get a job and buy one your self. Thanks bono for your help but if anyone else can help legally with rights then it would be appreciated

Dont take crap from the school about insurance thing. They will try to fob you off to see what they can get away with. They probably think school kids dont know much in regards to rights. Tell them you will get the family involved and they should take you seriously. Not sure what else to say and yes your right about people buying stuff of their own but thats thieves they could not care less. I had my phone stolen at work years ago from a draw in the back office by a member of staff. It was many years ago and it was a Nokia 3210(thats old) and the hotel replaced it. A member of staff took it and sold it on. He was sacked. So the hotel replaced it and that in my mind was right although i was surprised as i left it in a draw.

Yeah the insurance guys will surely try to mess You up as usual! Do Your parents have an advocate? If they do why don't You ask him for an advice? He'll surely help You, that's what he gets paid for. |

I would expect that if you paid money for the use of the locker that you also signed some agreement/contract for the use of the locker, and I would assume there was some disclaimer for liability much like there is when you pay to park cars in car parks?
If not, are there signs around the locker room that have disclaimers for loss?
somehow I would expect there is something that implies the use of the locker is wholly your responsibility, unfortunately

Surely that disclaimer does not stand when something is locked up? We have signs up in our hotel but thats only if you leave things lying around

No signs and the only thing we signed said we hired the use of the lockers.

Disclaimer is difficult one. In our hotel its if something is stolen when left lying around or if stolen whilst on your person. If locked up on hotel grounds then its different for guests.

We don't use lockers in DR. And it's hard to me to tell you what can you do. They stole you inside the school. Somehow it makes them responsible for your loss. A friend had his gf's car stolen from a mall's parking. The curious part lies in that every time you get in the parking you're given a ticket. The girlfriend took the ticket with her and while she was with it the car was stolen. What it means? That, maybe, the security guy was the thief's alibi in this case.
It's been a year after that and they have not sorted it out. My friend and the gf sued them but it has taken a lot of time to come through.

I know but at the end of the day it makes you want to break into someone else's locker knowing you WILL get away with it (i wouldn't but you get the idea)
