What's Esato's policy on themes that have been uploaded freely by members being offered for sale on eBay?

Doesn't seem right to me.

that piece of info is just too gross (at least for me).

i do themes and share these freely over here and at mobile9. in the process, i also download themes and customize these to my taste using SE Theme Creator. if i find my work worthy to be shared, i post them with proper acknowledgments. but selling these? just like what rambalu had posted ahead, these are all over the internet! and they are FREE!

i wonder who this seller is...

Yeah - anyone who actually buys them must be a real thicko. But there are plenty of thickos out there. Believe me - I've met plenty of them.

I also write themes and post them freely on Mobile9. I've even had some published on Esato. I was really pissed off when I saw the eBay item and others like it. I imagined some spotty little toe rag, sitting in his bedroom ripping off our hard work and creativity.

I was just wondering if Esato's admin had any thoughts on this, especially as his listed image actually shows a standby screen with ESATONET on it (how thick is that?). Maybe it even contravenes eBay's selling policy. I dunno. If it does, perhaps Esato should ask eBay to delist such items.

Ebay has a Verified Rights Owner (VeRO) Programme to facilitate cooperation between eBay and rights owners protecting their intellectual property rights. If anyone from Esato's admin is reading this, please consider contacting eBay regarding item numbers: 6473773871: 6473774103: 6473774272. Ebay insist that only the owner of the intellectual property can do this.

Hi all,

I agree with what has been said if he made the themes himself and sold them that would be fine but selling other peoples work for profit is just wrong. I would say though there are plenty of users of those devices that wouldn't have a clue where to look or even how to install them, but that still doesn't make what he is doing right IMO.

In most countries i think this is illegal ! Unless of coarse the seller makes the themes him/her self. I know in australia it is illegal and ebay would have to take action against it only if we can proove the themes are stollen and being used for financial gain. i.e we have to find the artists of the themes and talk to them...

Really it shouldn't be to hard to track down the artist however eg i'll go see if i can find th artist to that green esatonet theme now.

Ok found the theme its number 376 in K600 themes, i opened it up in SE Theme Creator and the artist left nothing but Organization:Chadiwrx 2005® so i'll do a google search now.

EDIT: Turns out he is a user here on esato how easy was that http://www.esato.com/board/bb_profile.php?mode=view&user=74283

It looks like we have some investigating to do.....

He's also a colleague of mine on Mobile9 and he's based in Australia.

I've given him a shout too so he can visit this thread. I guess he will be mad as hell that someone is flogging his stuff (and ours) on eBay.

this is a case of intellectual property rights infringement, mates!
i wouldn't mind if proper acknowledgments be made by whoever uses any other's creations for (legal) reasons other than its real purpose...

fyi: mobile9 would not post anything they deem to be a case of such. i tried contributing F1 (the fanatic that i am lol) wallpapers before that i cropped and resized at mobile9 and they were rejected... hope e-bay has this some kind of control.

I have also reported the seller to eBay as I suspect that my themes are more than likely to be on his tatty CD too.

I suggest that everyone who suspects as much does the same. It only takes a few minutes. Get the item up on eBay (hit the link at the start of this thread) and scroll down to the bottom. There is a 'Report this item' link to follow.

I used the following text: "Message: I create mobile phone themes and post them on ESATO.NET and MOBILE9.COM freely for the online community. I strongly suspect that some of my themes will be included in this listing. I know for certain that the cover photo for the item shows a theme created by a colleague of mine on ESATO.NET (Esato ID = Chadiwrx) and that he has already reported this item as breaching his intellectual rights."

I have reported three of his listings.

Bombard eBay till they remove the items!
