In past I have had my mobile phone insured with orange, and they have provided great services in replacing a lost, stolen or a damaged phone usually within 24 Hours!

However this time around I'm insured with another company called 'FoneSure', I'm using a T-Mobile MDA Compact ii therefore I could not insure with orange (even though I use orange line) because they phone is not their brand.

Fonsure's Policy says: That the phone will be replaced in 48 hours (later i found out that was only for theft phones, even though last time i made a similar theft claim and it took them almost 3 weeks to sort it out) however this time my phone has bee damanged ad I've sent it for repair. In the policy it clearly states that a damaged phone will be repaired and dispatched between 7-14 days.

It has been over 2 weeks (16 Days) that I have sent my phone for repair and have not yet recieved it back yet. The Insurance company says that their repairers couldnt repair the phone so It had to be sent to the manufacturers, the manufacturers currently hold the phone and they are not aware when the phone will be reparied and how long it will take.

The question now is, what are the legal rights or procdures that I could use to force them to either fasten the process or buy me a new phone, as it is very hard for me to organise without that device as I had my navigation system on it aswell as other office tools that help me in daily life not to forget I also used it as music player.

Has any of you of experienced anything or simmilar or could suggest me any ways of dealing with this? I have spoken to them on the phone various times and all they could tell me was to wait. Any suggestions will be much appriciated.

Go to a T-Mobile shop and explain the situation and they will assist in resolving this for you-they've done it for me before! :-)

As it had to go beyond their own in house repair service it is out of their control as to how long it will take. Although they should be as helpful as possible to make it a speedy turn around, I dont think you will have a peg leg to stand on legally.

does everyone not know that they are covered as standard under most house content insurance policies and in fact the need for phone insurance is not necessary.

I dropped mine in December and my house insurance sent me a new one next day in the post.

Thanks for the comment so far.

I can't go to a T-Mobile shop because the phone was sent to me by the same insurance company before and they had purchased it for me, secondly I dont use a T-Mobile line or their insurance services.

The only place I can right now contact is my insurance company and they have not yet met what they say in their insurance policy (I guess they never do apart from orange care). So right now all I can do is call up the insurance people everyday and that is only going to cost me money as it is an 0870 number and via mobile its costly as it is during peak hours.

I am looking for an alternative method of making my insurance company to send me a replacement phone but I dont know what that method could be.
