Phones4u / Voda - URGENT help needed! |

Hi,
I am currently having a major problem with phones4u (UK) and returning my phone. Im hoping someone can give me some advice as to what to do next...
On 3rd June I signed a contract with phones4u for a voda contract and a siemens benq ef81. I was porting my number from o2online and supplied them with the PAC code on the 3rd. Due to their incompetent staff not listening to me (I had a couple of midweek trips abroad), the port date was eventually set at 22nd June. I did not receive a phone or a sim on the 3rd.
I went into the store on the 22nd and collected my new phone and contract (sim activated on the 22nd with new number). Having played with it for a few hours I deceided to return it (under their 14day guarentee). However when visiting the store they said I cannot return it as it is outwith the 14day guarentee (which they say started on the 3rd!!!).
Several phonecalls later I had phones4u on the phone saying they could cancel the contract. I also phone voda to see what their take on the situation was- voda said contract started on the 22nd (commencement date) and as such I have 14 days from the 22nd to cancel. Unfortunately on returning to the phones4u store they changed their minds and said it is now non-refundable despite what voda say (I spoke to the store and area manager).
So at present I have phones4u saying I can't cancel and voda saying I can (and voda are supplying me with my PAC code to terminate the contract).
I do not know what I can do with regards to phones4u now. I have a phone from them that they will not take as a return despite voda agreeing to cancel this contract...
My main question is... If I receive the PAC code from voda and port my number off, thus terminating the voda contract, what will happen? Will phones4u still be able to bill me? Will they then request the phone back?
Does anyone have any other suggestions? I have spent all day today (Saturday) going round in circles with phones4u and despite voda being in complete agreement with myself I cannot seem to solve things with phones4u.
Should I just take the pack, cancel the contract and keep phone (or will phons4u kick up fuss?).
Sorry for the long email but its a tricky situation to explain. I hope someone can give me some advice please!!!
Thanks! |

Im drafting a letter to phones4u and ill mention trading standards. Ill also send a copy to trading standards themselves.
As far as i am aware my contract is with voda- so if i get the pac code from voda and cancel thru voda then phones4u won't be able to do anything until voda don't pay them (commission or whatever they get) for my contract. At which point they'll probably try and chase me up for the handset? Is this correct? |

Cheers,
Im not plannaing any more visits to their stores. They have point blank refused to cancel saying it is 'outside' the 14days (going as high as area manager). As far as I can see my contract is with voda so I think Ill just cancel that and see what happens- phones4u will eventually ask for the phone back I imagine?! |

This is absolute awful service mate hope you get something sorted, threaten trading standards that always seems to work espcially as you are in the right, some people try it on for the fun of it but in this situation you have a very good case, give them a ring and ask there advice.

of course
you may wish to tell them the handset is faulty, locks up during calls etc.
Faulty goods have to be replaced OR REFUNDED up to 28 days after purchase i belive
may be worth a go?
good luck mate |

Thanks for the responses...
I finally managed to get it returned on Monday. The threat of trading standards changed customer services minds. Unfortunately as i had to hand back the sim I have lost my number at present... Still awaiting o2 to deliver me something new!!!
Thanks again for the swift responses! |
