OMFG! Vodafone! please help! |

i am shaking with anger right now, im just off the phone to vodafone.
basically my sony ericsson k750i's earpiece broke after 3 weeks of owning it, when upgrading i went to alot of hassle to get the black version ie had to send the silver back etc etc
now, because its after 2 weeks they can only palm me off with a refurbished unit which they cannot guarantee will be black. so, they told me if it comes silver send it away back with the courier.
so, when it arrived, lone behold it was silver! so away with the courier it went, that was 2 weeks ago, since then they have been promising to phone me with no calls!
i spoke to a manager for half an hour there on the phone, and they are telling me they will send a phone but cannot guarantee it will be black!! this is complete nonsense, if i send away something i want the same back right??
i said if they cant guarantee it then they should give me a brand new phone, but they are not budging, i will bet any money the phone that comes this tuesday will be silver!
what on earh do i do here guys? i must have some kind of rights or something, i am not taking the silver cheap looking peice of crap and thats the end!
please help

Well from Vodafone's point of view (not what you want to hear right now I know) they have the silver K750i in stock ready to ship, they have special rights to brand there phones including changing the color to silver fom black.
This means bad news for you, as the primary K750i that they will stock is a fully Vodafone Live! branded SILVER phone the chances of you getting a brand new BLACK phone is highly unlikely one should think.
Sorry to have to say it but its also whats happened to a few friends of mine, so this is from experience with Vodafone.

i hear you, but, the fact is, vodafone sent me a black unbranded one as an upgrade as i requested it was the black one i was after, i amat a brick wall with them, there is no way im taking the silver as you know yourself its absulutely shocking looking, cheap, tacky total rubbish lol
i think i am going to have to go thru direct with sony ericsson, do u think i would be best doing that?

What are you going to gain by moaning towards though? They can't force Vodafone to give you a black K750i - the fact of the matter is that Vodafone are giving you a replacement under there warrenty. That warrenty does not state (as far as I am aware) that they have to give you an unbranded phone. This IS however due to Vodafone paying amounts of money to to change the original black K750i to a silver version and put a lot of branding over it.
Your best option is to take the silver version and use Davinci to debrand & unlock the firmware and then spend an extra £20 (ish) on a nice new black case for your phone and change the housing.
Sorry again but the truth hurts sometimes..

@Mr Myiagi - why should he stop complaining and be happy they are sending him a phon at all?!?! that is a ridiculous attitude! he is paying to be provided with a service, a large part of which is the provision of a specific requested phone. the phone is still within warranty and as such he is entitled to an exact replacement!
stick your ground with vodaphone - they don't have a leg to stand on. you specifically requested the black unbranded version and entered into a legally binding contract on the understanding that this was the exact product you would be provided with. If they now cannot provide you with an identical fully working replacement then the contract is null and void and you can leave with out incurring any penalty. Tell them this and say that you will terminate your contract with immediate effect. they will soon change ther tune when they think they are loosing a customer. if you don't get the answer you want then keep asking to speak to the person above that person. If they still wont budge threaten legally action in the small claims court and put a stern letter in to vodaphones complaints department (letters often have a better effect!)
best of luck mate and keep battling till you get what you want. the mobile phone networks seem to think that as soon as they have got you to sign up they can treat you like sh*t! more people need to stand up and use their legal rights and let then know that they cant!

i wasnt meaning that, i was meaning if i try and get se to replace it under their 1 year warranty rather than go thru vodafone, then i would at least get a black one?
ive been thru the changing case lark before, the phone is never the same afterwards ie sticky buttons etc, they are cheap copies from the middle east and not official se cases, so the quality is gonna be crap?
tom to be honest mate, ive tried that with the manager i was speakin to, she just wasnt budging at all, if i go the legal route, i will lose problably as they are sending me the phone of the exact same spec just a different housing, then ill just look like a fussy b@stard lol

Well if you still had the original nlack phone with the problems you could have taken it to the service centre and told them the situation. They could have probably fixed the phone for you (maybe at a cost,but it seems like you would prefer to pay £30 rather than have the silver branded one) and then Vodafone would never have needed to know.
Have you sent the phone back yet then (I'm guessing yes) but if you did have they given you a replacement to use whilst this process is ongoing as they should have done, not really for legal reasons, mainly just out of the goodness of there hearts and to keep you (the customer) happy.

Naturally theres no way on earth you should accept receiving anything other than what you originally ordered. The thought is absurd.
If I buy a black car, its because I want a black car, if it needs to be replaced under warranty, then I should not receive a pink car, makes no difference if its the same type of car or not. Its vodas problem if they have trouble with stock, not the customers.
Stand on your right and insist to get the same.
You will not lose in a legal battle

Because complaining about a phone's colour is pathetic? The previous poster was correct, swap the case if it's that important to you, it's quicker to do than posting your sad little tears on the internet. |

i used the exact example to them about the car lol (strange) i still have the phone here as they are only taking it away if the phone that arrives is black, usual, get a grip u tit, im not posting tears on the net, im looking for some opinions on what is the best thing to do, isnt that one of the ways forums like this are useful, you are not in my position so u dont have a right to make that comment, maybe u arent bothered about your phone but i am, i have a black phone, i want a black one back, end of! |

problem would be with vodaphones T&Cs
im assuming in the print there will be a clause of replaceing at there discretion with a refurbed unit of similar specification.this vague clause would allow them to supply a silver phone as it fulfills there T&C's
no harm in pushing for what you want but i would have a look through your documentation |

Right I've had enough of this complete rubbish from you know, if you haven't got anything constructive to add to this post then just leave now! Ok its not your problem, so stop trying to make it worse by saying a load of complete rubbish, yes I also saod change the housing, but thats extra cash plus then he/she would need to get it debranded etc. More money spent, but at least I only said that once..your just trying to get your post count up by saying useless comments over and over again, if I has my way your posts would be deleted on the spot because you are no use to anyone really.
