In my opinion the pic is not valid, because it is not taken exclusively for competition though it is clicked in this month- december but before the theme is announced. So, it can be considered as archived.
Same discussion has done in past in July'09. Also see the next page in it.
So your entry is not valid. Then also, this time as well, i welcome tranced decision, what so ever it may be.
