i have a question and a comment.

question: would someone pls define for the users of this thread what is being meant by "bluejack"?
can bluejack be simply defined as doing a search for devices in the immediate vicinity and then sending a non-destructive text or picture message to that device?

comment: why would the above definition be illegal? it is at worst equivalent to email spam. some countries are beginning to act to make email spam illegal. however, at the present time, bluejacking is not illegal, anywhere.

it may be bad manners, even unethical, or techno-geek weird. but not illegal.

what is needed is for symantec or some enterprising start-up to make great, light, anti-virus and firewall software for mobiles.

Would you agree that the contents of the message may very well be illegal? And in such a case the act of sending it, via any means, is in fact also illegal?

And that it is not the act of bluejacking itself that is illegal, like making telephone calls in itself isn't illegal, but passing a message that IS criminal (let's take threats for example) in any way is illegal... even when 'anonymously' sent from a bluetooth device or anonymous phonecall.

It's how people use the bleutooth facility that determines whether or not what they do is legal or not

bluejacking is probably only as illegal as sending junk mail...
so I don't think there should be any legal issues at all.
must differentiate from bluesnarfing etc
