Well, as the TOS states Gmail will monitor all your mail and you have to read and agree to the terms for a service and as you're free not to have a Gmail account at all, I'm not sure what the issue is.

Actually Google does not read your mail. From the FAQ:

Is there anything special about gmail, eg can it pick up your hotmail account email, or can you use outlook or outlook express to pick up your emails or preferrably both, or is it just simply an email address system with a huuuuge amount of storage?
Cos lets face it hotmail was fine until they stopped you picking it up using outlook express, who needed loads of storage when you can save it on your own pc? |

it has pop capability yeah and can collect from hotmail etc.
