Suppose it really depends on how long the stock has been sat on the shelf as to whether it has the latest firmware on it or not. Can you maybe contact via their 'contact us' option in the support area and ask the question ?

Check for the date when the phone was manufactured. It's printed on the sticker at the back of the phone. It's with all those bar codes and the IMEI #.

Like the most recent one in a local dealer has 05W04. Which means it was manufactured during the last week of January 2005.

Phones that rolled out of the assembly line after a new firmware came out should have that version installed in it.

The main difference between 3.9 and 3.10 is the fix to change the default flicker compensation mode from 50 Hz to automatic. Some people also report an enhanced picture under low light conditions but this is not listed as an official fix so I guess it was a byproduct of the afore mentioned fix!
