according to that article, Apple is counter-suing Samsung against action "Samsung filed with the High Court in June", so Apple are not taking the first step in this case.
Also, the patents involved are unknown so I'm not sure this story without any real facts adds much to the discussion?

Samsung wins appeal on Galaxy tablet ban in Australia (BBC article)
Samsung has won a major battle in its ongoing tussle with Apple, after an Australia court overturned a ban on the sale of its Galaxy tab in the country.
Apple had won an injunction against Samsung in October preventing sales of the Galaxy 10.1 tab, accusing of it copying its touch-screen technology.
Samsung has since redesigned the tablet.
The overturning of the ban is likely to provide a big boost to Samsung ahead of the Christmas shopping season.

German court tosses second Samsung suit against Apple (c|net article)
Samsung Electronics suffered another legal blow after a German court today rejected its lawsuit against Apple, the second such dismissal in a week.
