Apple to Samsung: Stop stealing ideas

Apple says it's sick and tired of Samsung ripping off the iPad and iPhone, and the Cupertino, California, company is filing papers.

In a lawsuit filed Friday, Apple accused Samsung of committing patent and trademark infringement with its Galaxy line of mobile products. That includes the Galaxy S smartphone and the Galaxy Tab tablet.

"It's no coincidence that Samsung's latest products look a lot like the iPhone and iPad, from the shape of the hardware to the user interface and even the packaging," an Apple representative said in a statement provided to All Things Digital. "This kind of blatant copying is wrong, and we need to protect Apple's intellectual property when companies steal our ideas."

You cant put a patent on a style of phone... Apple make good products (albeit over-priced) but they're far too heavy on suing the competition.
Competition drives progress, if there were no competitors to the iPhone or iPad, then there wouldn't be the rapid developments in technology that we are seeing today with all these huge companies bringing out phones and tablets.

Most people would say that the Samsung GS looks a lot like the iPhone 3 in more than a few ways.

Not sure about them claimng to have introduced 'grid presentation of the App icons' though.

Does Apple feel threatened by the coming of the Galaxy S 2? Hmmmm...

That is my next phone.

Whahahaha

Posted by rikken
Isn`t Samsung one of Apples supplier of components. . . . . . .

Posted by Bonovox
Yes it is but looking at the two phones it does not look EXACTLY like it. It's hardly an exact copy of the 3GS. And loads of manufacturers steal ideas from each other. Bloody Apple

Posted by julias
Apple has just about sued every major mobile phone company out there if not for design then its the OS if its not that its the components and so on and so fourth soon they will be suing themselves next if they don't stop its getting stupid

Posted by mriley
I feel sorry for their lawyers

Posted by Bonovox
And who next?? Motorola for making their own tablet?? What planet are Apple on?? It seems to me that Apple want to get rid of their rivals and take over the world. Android is doing far better than IOS now and they simply don't like it. How far does it go?? You sue a company for making a product in direct competition?? Give me a break. Only in America eh?? Like the idiots who tries to sue McDonalds for their obesity. Seriously you have a choice if you eat it or not. Am I right?? Apple I will be shocked if they win. I am just imagine in the court room with the judge comparing the Galaxy S v Iphone. Most touch screen phones look the same.

I don't as the lawyers stand to benefit the most from this even if no outcome is reached these are hardly no win no fee cases

Apple,rotten to the core

Posted by skblakee
Ooh, those poor lawyers who stand to make millions, win or lose. I feel for them.

Samsung should just cut their supplies to Apple. No iPhone 5 then eh?

Posted by Bonovox
Indeed. Sorry but I really do think Apple are pathetic in all this. Sony Ericsson should cut supply of their i phone 5 camera module too

There will probably be some kind of settlement of this whole things as Samsung has pledged to sue Apple as well. Both are huge companies with little or no time waste on such trivial matters as law suits.

Its common for a company to file patent for all their product even on the style of the product.
if you try to do some search on Motorola. They did the same on the product styling as well since it is still IP ...they even file it for their walkie talkie which you should aware didn't have anything special on styling.

Posted by c96sthl
it wasn't common you see a big OEM suing another OEM for copying product style.

you can see Auto maker from US or Europe filing complain of China copy cat of Smart for two/ the China QQ car or the BMW SUV look alike....but normally its big co against small co.

for what I notice on Galaxy phone, the home screen don't feel like iOS but once you go into the menu with all the icon. It does and most phone ad tense to use the icon screen in promotion. Plus the shape of the new Galaxy to have resemblance of iPHONE3Gs. They can argue it is not exact copy but it does resemble it.

To make it worst is Apple claiming Samsung even copy the packaging....that's like claiming a big company like Samsung is lack of ideas.... in a way for one who know well how both company do business....maybe you will know which side you are on. But well...mean time we should expect more attack and counter attack will continue.

it is funny now apple is claimed by some site (can be easily googled) that A5 processor no longer made by Samsung but TSMC (only A4 is) and also news they have two Nand Flash supplier (Hynix and Samsung) while we rarely hear Samsung providing any LCD to Apple plus apple also not using any AMOLED.....just making me wonder....if the dispute get worst. Will Samsung be cut off from Apple supply chain.

Posted by mriley
Wow this is like a competition oh which company can file the most patent infringement claims
Well, to put a serious summary of all of this...
I like Apple... and I like Samsung, but which is better?
There's only one way to find out!

As much as I hate to admit it, yes you're right

Posted by adsada
As much as I hate apple, I do agree with them on this. Samsung clearly are trying to compete with Apple, I remember when the galaxy s was realised last year, my first thought was "damn that looks like the 3gs". Then their new galaxy s has similar shape to the 4. It's clear on the tablet side, that Samsung are carefully checking Apple with the Samsung boss saying that Apple made the new iPad "very thin". They then changed their tab to follow suit.

Although the remakes of these products clearly outdo the features of apples features in relation to value for money (no wonder their shitting themselves). I believe though that in this day, this type of phone is very popular, but it does annoy me seeing companies having to copy an annoying company such as Apple. It just makes them look even worse. That's why I appreciate line up, which is totally unique, because a company should compete, not copy.

Really, they should stop stealing...Look at the Audio Hardware on Samsung phones, not to mention the UI.

Well Apple just lost this one against Kodak

The thing with Apple is they release One Phone every year,
and in that time others are keeping up more advanced, I think apple just see
them as a threat and want to have a POP at all of them for this reason

ive lost count how many sues its been with them lol

also those Devices may look abit similar to those of Apple however they don't
sport iOS 4 so Apple are just a Big laugh at there own accord

Looks like Dell might be about to get into trouble with Apple next their new laptop looks strangely familiar doesn't it?

The latest news on the Apple Samsung case is that Samsung now has to show their products to Apple prior to being shipped so Apple can examine them for possible patent infringmenets.

Samsung has made it clear that their design division in question is in no way related to the division that supplies Apple with components so no need to worry about that, despite this whole patent case.

Posted by skblakee
Well guess what, Samsung says that it is only fair to see the next iPhone and iPads.

See it here and here.

Hahaha Ya i read that too. Except apple has never released a product that looks anything like a samsung product. The fact that the galaxy tab 2 was already shown then recalled to "change strategies" when the ipad 2 was released shows who copied who.

Posted by jj03
Lol @ apple... they aren't above stealing idea's from the competition themselves...fuckin hypocrites.

Posted by jplacson
Ya, except they're the only ones smart enough to patent the design.

Posted by julias
The problem is that Apple claim to have invented everything next they'll be claiming to have invented to the mobile phone too and because they have so much power now and everyone is in awe of them they seem to get away with things.

Samsung To Apple: You Say “Copyist,” We Say “Competition”

Samsung Drops Counter-Suit Against Apple

Samsung Electronics Co. dropped a patent-infringement suit against Apple Inc. (AAPL), filed at a U.S. federal court in April in response to allegations its Galaxy products copied the iPhone and iPad.

To clarify, this does not mean that Samsung has abandoned its own infringement claims against Apple. Those claims have been rolled into counter-claims in the original suit.

Court tells Apple August 5 hearing on Samsung ban too early

Judge Lucy Koh told Apple in a weekend hearing that its request for a preliminary ban on Samsung devices might be too quick. The iPhone maker had suggested a hearing on the afternoon of August 5 but was told that the timing might not give either side enough time for discovery to prove or disprove the need for a ban. Both have until July 8 to provide a joint statement either agreeing on a schedule or explaining their views if they disagree.

Today the initial proceedings in the legal dispute between the two companies came to a close.

A judge in The Hague just issued a ruling in Apple's patent infringement case against Samsung, prohibiting the marketing of Samsung smartphones Galaxy S, S II and Ace for violation of an Apple patent.

Posted by goldenface
I thought it prohibited the sale of them in 7 countries including the Netherlands, which is their logistics hub for Europe. They should have a workaround.

Now I'm wondering when google will start throwing it weight around now it has Moto's patents.

Posted by julias
It shouldn't affect Samsung too much as According to Tweakers.net, "Samsung says that it will replace the software that infringes on Apple's patent (the Gallery application, specifically), which should allow it to continue to sell the phones. Notably, that Gallery application is the standard Android one used in Android 2.3, which also explains why the Galaxy Tab 10.1 is not affected by this ruling. Less clear is what the ruling means for other Android phones that use the same application."

So Apple holds the patent for the screen to screen swiping technique and scrolling through a gallery using your finger?

Posted by admad
Yes, isn't it ridicolous? I really hope that some hacking groups will take action and strike Apple with all the force. Enough of Apple bullsh*t.

Seems like it yes.

So hopefully after the fix Apple will leave Samsung alone?

Posted by goldenface
I doubt it. It looks like they will be gunning for others through the courts.

It will be interesting to see what workarounds they come up with.

And Steve Jobs has just resigned

Ok, a patent has nothing to do with who invented something FIRST. It's who files for legal ownership FIRST.

Most people don't know, that in the tech industry... most companies do NOT patent their inventions. Intel and Google have far fewer patents that people think... despite having invented a lot of technologies.

The reason behind this is simple... when you patent something, you must show proof of concept. A working prototype and the method by which your product works. In other words, you must show how your magic trick works.

If a patent is all that was needed to keep corporate secrets safe, then the world would be a better place.

Coke doesn't have a patent on it's secret formula. It doesn't trust the patent office. And rightfully so. If it did, it would be spending more money chasing down copycats and shutting down illegal factories.

Intel and Google do not patent their tech because it's safer to just keep them secret.

Apple knows how to play their strengths... If no one has a patent on something that's already out there... they can patent it. Then claim royalties.

***Patents also have a lifespan, usually 15 years AFAIK... This is why most Japanese cars use German technology 15 years after they were first introduced by Porsche, Benz, BMW, etc. Benz made the exception when they patented crumple zones and a few more safety tech which they granted free use of to improve over-all car safety around the world. Motorola held the patent for the active flip phone which is why no other phones at the time were active flips. Only after the patent expired was able to use it for their T28***
