Hope, you'll get it sorted, even if it's "only" 40 gbp, scam = scam !
These kind of people should get an IP-ban, doesn't make it impossible for them to come back under another name, but at least it's not so easy.

id agree matey,
and i know its just £40..... but the real pain is the fact i have 2 x new housings, a new battery, new charger and new data cable with nothing to use them all with - bummer!

Well I think by now it's been proven: the guy is definitely a scammer. So I think you should stop waiting and actually take action. He's clearly not gonna do anything about the issue (just like tho other times). Maybe bring the police along with you. You could try to get in contact with others that were scammed by him before and form a "scammer takedown team".

your better off lookin in local paper for an s700i as i got 1 for £30 boxed unlocked brand new headset and mem card cover abit tatty but can replace it cheap im happy yippeee |

I bought one last year for £50 delivered from eBay..
it's a brilliant phone..
got stolen though 
 should bring out something like it again but smaller,
nokia have got that 7373 thing afterall
