> eBay isnt a venue or it would get taxed, its an online auction house,

Read the User Agreement - http://pages.ebay.co.uk/help/policies/user-agreement.html

3. eBay is Only a Venue.

3.1 eBay is not an auctioneer. Although we are commonly referred to as an online auction web site it is important to realise that we are not a traditional auctioneer. Instead, the Site acts as a venue which allows registered users to offer, sell, and buy just about anything which is legal, at any time, from anywhere, in a variety of price formats. [addsig]

I imagine 'as new' is open to a lot more interpretation that stating something is 'new'. [addsig]

I guess at the end of the day, the lesson is to read the whole listing, just in case there is a mistake in there.

edit:
And just as he has the right to claim a refund, I have the right to inspect that the item was received as it was sent.

A 'mistake' like trying to pass a used phone as new? Or still trying to charge 4% for PayPal?

How about a lesson in your obligation to use clear and honest listings? [addsig]

how about you stop acting silly with your remarks and advise amnesia how to stay out of trouble instead of slagging him off

What lesson can I give to someone who refuses to accept they have/are doing anything wrong?

The thread is now about how someone hates eBay (perhaps the original title was unsuitable?) yet all the issues were caused directly by the seller and how they list. They CONTINUE to make 'unclear' listings. I, and others, have pointed out potential pitfalls.

Why don't you help him, too, instead of criticising me? [addsig]

abs, you clearly do not follow up with things, if you've seen the phone's listing since yesterday you'll see it's been updated, and even the person (kk) who was the highest bidder was able to understand what I meant by my listing BEFORE I updated it.

Edit: AND you genious, I made that phone listing BEFORE this thread.
You can't edit the description after someone's placed a bid. You seem well versed with the way ebay works, you should know that.

I see it's updated.

You mention it's locked to T-Mobile now (an easy omission)

You say it's new; it's not. "the only thing that was used was the charger, (everything else is untouched)."

You still want 4% for PayPal; "However if you request to pay by paypal, can I please ask that 4% is added to the amount."

Whe it all goes so wrong (and I hope it doesn't), I hope you won't complain about eBay here. [addsig]

*sighs*

I'll have to quote my listing for you.
PLEASE READ!

" note: this phone is As New. It was used for a couple of days, is exactly as it should be out of the box. "

and

"There will be NO extra charge for using paypal. No 4% to be charged"

I can't chang the payment instructions! You keep going on about the rules and the way ebay works, but YOU should know them yourself before opening your mouth.

And if (God forbid) something does go wrong, I might post about the event here. As you said, it's a public forum. Plus even if I do, nobody is guiding your hand to click on the thread.

I see you don't even acknowledge that you missed those two points and made a mistake yourself.
