Yes that is the case it is a mp3 file but when i click 'use' it shows the set as ringtone function but in faded grey so i can not use that function

is your phone branded? some carriers place restrictions on how you can use media on their branded phones.

Maybe its not the correct bitrate

I am on Vodafone and it is a branded one!

How can i check the bitrate? It was ment for a mobile so cant see that being the problem?!

you may want to check with vodafone, but from what i've heard, voda-branded phones have some kind of protection against media files that aren't purchased from them.

i hope i'm wrong...

It "sounds" like a Voda problem. If you search on "digital rights management" here on esato, you should find some posts on how to assign DRM to the MP3, which may allow you to play it.

No you donīt!!
Vodafone has a protection (i donīt no why?) So you can not use mp3.file for ringtone!!
