@namzo: like you know!!!! nothing will come out of this except some officials looking for bribes!! anyhow, it maight be good in the long run. not in cayching "yahoo boys" but in getting used to regulating things in naija. toooooooo many things are unegulated. Recharge hawkers on the road to Toffee factories.

@namzo good overview
@all that is pure ABUSE OF OUR FUNDAMENTAL HUMAN RIGHT. My main grouse with these law enforcement agents is that majority of them know next to nothing about the Internet. For instance a source informed me of an intance some policemen came to a cafe, they 'raided eveyone in sight not mindful of each person's activities. He along with some other innocent ppl had to part with #500 each in other not to be taken to the "station" - can you beat that.
someone also said that some cafe operators aids the so called "yahoo boys". That is just the bitter truth coz these boys oftentims are amongst the heavy "browsers", and thses operator are out to make money - they will ague.
at another time i was opportuned to listent to the conversation of some police officers, the conversation goes thus:
OFFICER 1: Ol' boi town hard these dayz oh
OFFICER 2: to chop now self na wahala (pauses and continues), my wife self no gree me rest.
OFFICER 3: I been hear say "yahoo boys" full surulere and isolo area, and those boys dey settle well.
OFFICER 2: e be like say we go carry out routine raid for that side oh, at least we go get something.I'm not an advocate of yahoo boys, but I strongly believe what the law will achieve is that more ppl will rather subscribe to personal internet connection, meaning that the cafe operators will eventually be made to pack shop.
FOOD FOR THOUGHT

This means that to register as a user, the user's name, address, telephone, e-mail address and photograph should be available, according to the Act.
The President signed the law on June 5, 2006. And for the purposes of identification, three key data should be provided, from the following: national identification card, drivers licence, international passport, utility bill and/or certificate of incorporation if need be.
According to the Act, telecommunication operators, including GSM service providers and PTOs, which now offer skeletal Internet services on their networks, also have up till September 7, 2006 to register such services with the EFCC. They are also to show evidence of Due Care and Surveillance System, which they have installed in their networks for the purposes of the monitoring of cybercrimes.

@all About EFCC, my views is that how can u catch someone if u don't ave a data base or records that u can check from? Which records do u ave in Nigeria or is EFCC goin to use the data of the National identity card? Funny how our politician live a life of fantasy.

Here is one scenario:
A Yahoo Boy gets caught and the EFCC takes his phone to, say, MTN and asks for the call data records of any number he frequently calls. Turns out your name pops up and you get detained and questioned.
Or, the last person who did night-browsing used the PC you are now using. The EFCC sniffs out the PC's ip from the 419 emails and they come and grab you. But I think they will expect each cyber-cafe to have a log of who browsed and when. So b4 browsing, we each must register and "clock-in".
But like Brix said... it will take some additional processing power to keep all those new records.... something our networks will definitely balk at.
BTW... good to have you back Demmy.

I'm yet to see a copy of this EFCC cyber crime law but going by what I read on it so far(on this thread),I dont see how it infringe on human rights of an honest cyber businessman. We cant afford a lawless society,I mean.

@uchrik Good talk, but do you know some "yahoo boys" usually install softwares in almost all systems in cafes with or without the knowledge of the operators, to steal people's passwords after you might have exited a system. Thereby having access to all transactions you might have made and so therefore continued from where you stopped - impersonatint YOU. Maybe I need to remind us that some people trasact legit biz on the Internet, foe instance WESTERN UNION. can you try to imagine whta happens when someone intercepts your western union details b4 u get to the bank to make your claim. These these happens all the time and the law will only make it legit for dubios cafe operators to steal our identity. As an instance a source ones told me of an experience where someone spied on his password and subsequently changed his password. The truth is most cafe operator are as dubious as "DUBIOUS"
@all now that we make use of the acronym "YAHOO BOYS". The question is who are they? Please I need answers

Demmy,we all agree on a thing,i.e;fast players or who may be called 'yahoo boys' hav turned the internet into a means of carryg out nefarious activities. To tackle this problem we hav to start from somewhere.Thats what EFCC is trying to do.
Posted by ambyzown
Howdy everyone.
I have long known that browsing thru cybercafe's is a dangerous pastime for any sane individual in Nigeria, hence my investment on home connections. However, the negative image these "yahoo boys" have created about Nigerians is so bad that any laws that may try to curb its growth is welcome.
The bane of this law remains its enforcement. EFCC already has its hand full as it were with cases of financial misconduct. There's no way they can take on and effectively tackle the menace of cybercrime emmanating from Nigeria. These crooks are a lot smarter and more knowledgable in the digital world than the average EFCC agent who doesn't know the diffrerence between an IP address and a node.
The drawback of this law is that Vmobile may have to begin billing for gprs if it has to "Register" this service. As we all know, registration will not be free abi?
Posted by uchrik
Ambyz, you are quite right, enforcement is an aspect of real concern in the whole issue. Not only in this EFCC law but in all Nigerian laws. Many critics hav said that Nigeria has the best laws in the world but these laws are not implemented.

Oh... is that the change? All I heard was that 3 more year had been "added". Ok, good idea. As far as Secondary School remains 3 years and not a year more.
On the Yahoo Boys... believe me, the EFCC will have its hand-cuffs full as more ppl get on the internet. I am wary of my personal info getting into every cyber-cafe register. Besides, any Yahoo Boy worth his salt can get a V-Sat and browse from home.
I agree with Amby that the EFCC is in tooooo many battles and is waaaay out of its league when it comes to cyberspace. It is doing the work of the Police, Customs, NAFDAC, SSS and the Prisons!

I think EFCC has become a kind of mad dog that need to be tamed. Their approach to crime fighting is akin to something like demolishing a house to prevent the house owner from being robbed! I have no doubt there must be a better way to control the activities of the few number of the Yahoo! Thieves around than to tie a noose round the neck of the over 90% of the rest of us who are legitimate users and the potential yahoo thieves who have chosen the better path of operating a cybercafe to ammeliorate the hardship that his excellency the "life leader" has imposed on all of us.

@coola: I can only comment on the issue of the DStv ban. It's simple if you choose practise capitalism you can't change the rules to comfortably suite you when you find it convenient.
In all other countries sports rights are bought on the basis of them being exclusive...because there's hardly any pay-tv operators in Africa it mad perfect sense that DStv bought exclusive rights for the continent...if ppl object to this there are courts of law to challenge the current regime.
I'm not arguing the fact that DStv is a monopoly, even in SA it's a monopoly but pulling stunts like the NBC won't help to attract investors to the sector.

Abu,sorry to draw you back to the mtel issue.I use a prepaid mtel line but mtel Customer Care tells me that gprs is only available on postpaid and they suggest that I convert my line to postpaid if I want gprs.I want be sure that it is really available and free before I take the step.

@brix, seems u don't know d effect d Eng Prmr leag.has on nigerians. Its d only reason why many peeps subscribe 4 dstv. All other local cable or sat tv companies are dead. Since Dstv has rights to africa they should share such, but no they wont.
Posted by brix25
@2tek: If you spent all your savings buying a house do you expect squatters to move in when they've been living irresponsibly all their lives and not saving? I'm sorry for English Premiership fans in Naija. It doesn't make sense for the NBC to come up with it's ruling this late in the process- quite suspicious.
In the same breath, DStv could sell some of the rights to Nigerian broadcasters-question is would they want to pay?
Posted by coolapostle
| Quote: |
|
I think the NBC is just saying "we refuse anyone buying the rights for the whole of Africa" .... "we want it to be bought over Nigeria as a seperate entity AND Nigerian companies be given a fair chance".
NBC has its problems, but I think they will get much support here. Our local DTH players must be encouraged.
Posted by brix25
@coola: If DStv had to buy the rights for all the African countries in which they operate then the rights to something like the EPL would be more expensive. As things stand they would still be able to buy these rights as there aren't many rival broadcasters in Africa willing to fork out millions for the right to broadcast top-shelf football.
Posted by ambyzown
| Quote: |
|
Quite the contrary, this is one of the few issues where I agree with the regulating authorities. Multichoice has refused to allow any other operator within Nigeria access to the EPL, cost here is not an issue. I have privy information on how FSTv offered MCN 50% on subscription accruing from viewers watching the EPL on FSTv, and it was turned down.
There has to be competition for any industry to grow, and I wholeheartedly welcome this decision. DSTv Nigeria, I can say charges the highest tarrif in the Pay per view industry worldwide.
@Brym: welcome back, I'm sure you know you are one of the causes of low posts on PNF. Howz madam?
Posted by coolapostle
| Quote: |
|
I think that is what caused their problems... the tariffs never change from year to year. There was NO WAY we would ever get 1k /mo for ANY bouquet on DsTV with the monopoly they had.
And all they did was just set up offices to collect money. I read that in the 15 years that they have been here, they never invested in even a studio.
At least, now we are sure things will change...
Posted by abubakar
@uchrik: I have never heard that before but this may be a new developement. how much does a post paid line go for anyhow? Im using prepaid and i guess Coola is too. I got my hook up long ago. Maybe Coola has more info to put forward.
@amby: this whole rights issue is straight forward. If say FIFA is selling exclusive broadcasting rights to Africa or parts thereof, once DSTV has picked it up no one should complain. Most likely Fstv was looking for rights in Naija only. If You were FIFA for example would you try to sell rights peicemeal and end up not getting All countries or would you sell it all in bulk!! If Fstv wants the rights they should step up as DSTV has over the years in their area of coverage and bid against DSTV next time.

Abu,mtel customer care says that to acquire/change to postpaid status someone has to fill a form at their nearest office.I gather that required info hs a lot to do one's financial standing. With this I doubt whether the gprs is free or not.
Posted by 2tek
@abu, fine other dth operators can attempt to buy such rights, but it aint easy. I remember when mcn started then,it was a struggle too. But we need to give the new cats a level ground to make something out, more like a reset button.

I call the MTEL postpaid an "abracadabra" product...
Without an insider, you have to pay for MTEL... but why not go for the postpaid? After u are plugged into the netwrok, I can give u the apn I am using and maybe it will be free.
I don't think the requirements will be more than paying upfront and a bank account.
@Abu... FsTV and Co must be protected.
FIFA cannot kill our local DTH Guys because they want the highest bidder available. Multichoice cannot remain a monopoly all thru my adult life... haba!
Just watch... things will work out and the whole Cable industry will experience a major drop in prices and Premier League will be available for 1k/mo very soon. That is what is called PROGRESS.
Remember that MTN Nigeria CEO had told us that per second billing was not possible until 2007? Well... without Multi-choice, all those Prime shows will still become available one way or the other.... and for cheaper prices than today. In fact we will wish we had booted them out b4 the World Cup

@Abu: your analogy with the FIFA scenario is excellent. It also helps to buttress my point. If FIFA were to sell broadcast rights for a world cup tournament to say, NTA, even if NTA had the ability to cover the entire continent, it should allow local stations/operators to rebroadcast the matches at a fee right? MCN/DSTv has up until now refused to allow any form of rebroadcast. not for any fee.
Posted by abubakar
@2tek: that can be done in a fantasy world where we all drive Ferraris, live in mansions and our fridges are full of delicacies. The open market doesn’t work like that. What do you expect to be done? FIFA to sell its broadcasting rights to DSTV and Fstv? That can’t happen.
@coola: Protected from what? It’s not a monopoly. I would love to start my own GSM company but I don’t have the millions $$$ needed. Will you call it an oligopoly? The problem with Nigerians is that we love to get something for nothing (or next to nothing). DSTV subscription is high partly due to greed, partly due to licensing of their programmes. Fstv doesn’t want to pay high fees but wants premium programming. They should invest in improving our local FA then corner the rights to televise it. If FIFA/UEFA doesn’t charge such large amounts they won’t be able to give premium football. We want it for free! Why don’t we all also get free England Jerseys with Beckham’s signature? Do the Europeans get it cheap? No. Do they pay? Yes.
Lucky for me I don’t watch football so I don’t spend my hard earned salary on DSTV, Club jerseys or running around from sport clubs to shacking joints looking for a free viewing.
Do you know why MTN started per sec billing and prices came down? Glo made the infrastructural investment as well as paid all dues to NCC and gave competition. They didn’t whine that the $285M was too high or they didn’t get the opportunity to recoup like MTN or ECONET/Vodacom/Vmobile/???????. That is what has to happen with DSTV. Someone has to come in big or be innovative enough to bring something new to the table that DSTV cant easily take or mimic.
But if you want to see Prime television we need an economy that is commercially driven. When we have sponsors that are willing to pay for the advertizment then we can continue to enjoy our awoofism!!!!
@amby: the problem is that as with all products, the more available it is, the less valuable it becomes. if you can get it on NTA, DSTV and local stations, no one will like to subscribe to that network or advertizers would not want to pay for those periods. sometimes we have to step back from our perspective as a consumer and look at things as from a biz outlook.
Check out SETI@home @ http://setiathome.berkeley.edu/

The GSM analogy does not stick. Except, say, MTN has "rights" for all International calls AND ALL of us have to go thru them for any international call.... then they refuse to re-sell to others AND the prices remain high for ever.
The "Biz" perspective is just another excuse to keep prices high because the company paid others for the "rights". I don't think the European DTH companies keep prices so high that it remains elitist for so long becuase they paid FIFA something. Multichoice shot itself in the foot and now their cashflow projections for the year will need some serious re-evaluation. No tears for them from me.
Now the NBC has its problems but I am sure there is something in their operational code that allows them to protect Nigerians from monopolistic businesses like Multichoice DSTV. With GSM SIM cards going for next to nothing, we want to see similar drops in the DTH space. Booting out Multichoice will take us a major step in that direction.
