Hi all,
As some of you may know I got 3 faulty Samsung Jet's and then she offered to order me another phone (different model). She said that the difference in cost between the 2 phones is £50, and that she will put it onto my next bill, fair enough. But I was thinking that maybe they only gave offered me a replacement to stay within the contract and The Sale of Goods Act? ..... and if so, should I really have to pay the £50 as they are only trying to provide me with a working handset. I could do with something lawful to back me up because one of the big boss's is ringing me back within the next 48 hours.
EDIT: Reading in The Sale of Goods Act could this help (probably not but oh well )?:

The trader has tried to repair and/or replace the item and it's still faulty - what are my rights?

If the trader has made reasonable attempts to repair or replace the item, then you may be able to claim a refund. This refund may only be partial as the trader can take into account any successful usage you have had from the item.

Thanks for anyone's help
Luke

Oh god having bad luck again. Well at least its not faulty this time. Is it the Satio you got? Is it working ok? Not sure about the legal side others may know

It's ok but I had a rant over the phone. The battery is sh** lasts about 6 hours, and I explained to the ignorent woman (who kept speaking over me) that there is nothing in the instruction booklet explaining ANYTHING about the first charge at all. She said we have no control over what goes in the box but that's funny because they have 2 of their own bloody booklets in there titled "getting started". Anyway, she kept denying it and had to speak to her manager to get any sense out of anyone. He sent me a new battery via RM 2nd class, not happy.

Also I don't have that many problems with crashing quite happy tbh.
Thanks

Not good news .........
Vodafone have not yet called me up but I called trading standards and they said I have no rights lol. I'm expecting a call from a manager any minute now and have a list of reasons he should let me off with the £50 charge:
My family have had to take a combined 2 days off work and drive me through a 20.2 mile round trip
I have been without phone for 3 days
I have crap battery and am still having to put up with it plus I've spent a fortune on expenses such as screen protectors.
EDIT: Look at this, my genuine phone bill updated last friday, I've spent at least another hour on the phone since (191 is customer support)

Totals up to 122 mins - 2 hours plus it is not up to date
Wish me luck guys.
Thanks
Luke

The guy was going to do nothing and said goodbye when I interupted him with a rather loud "WOAH" noise. I was not going to give in and he put £25 credit on my account there for doing a Black eyes peas (meet me halfway, oh sorry )
Thanks all
Luke
