Hi Guys,
Ok nothing to do with phones but with people on here from all walks of life I thought someone may be able to provide some useful advice???
My wife went in to the back of a Corsa at a red light. Our (318i) vertually pecked the corsa on the rear bumper and the guy came out screaming and shouting for her insurance details. She checked his car and ours and there was no visible damage at all. After argueing for around 5 minutes he decided to just drive off.
Today our insurance company has called to say that dude is making an insurance claim against us and asked if my wife hit the car from behind. She admitted that the car did (very gently) touch the Corsa but there was no damage and that the dude drove off. We are now awaitinf further info from our insurers as to what kind of claim he is planning to file.
This is 100% an attempt to make a fake whiplash claim - is there anything we can do? We have both legal insurance on our car policy and home insurance. I really want to take this guy on in court! At the time of the accident neither did he collect evidence or witnesses and neither did my wife but this happend in the middle of town centre and there are police survelence camera's everywhere.
Any suggestions guys?
Thanks a ton

its a tough one as whiplash can take 24 hours to come out after an acident. to be fair these things can take years to get sorted but thats what you pay insurance for. fake or other wise very little you can do, the isurance companys will sort it. the bloke will have to go to see and independant doctor at some point to be assessed and the claim will be based around what the doctor decieded.
the fact that neither party reported the accident to the police will probably make no difference though he must have taken your wifes reg at least for the insurance comapny to contact you.
as for taking him to court i would guess you could only bring out a private case which would be very expensive.
these fake claims are very common and i bet he gets something out of your insurance comapny in a few years.
if i was you id just give the details to the insurance comapny and let them sort it out as youve probably got little chance of been able to do much more sorry to say

I wouldnt worry to much. Just tell the truth and your insurance company will sort it out. Insurance companies will do all they can not to pay out.

Cheers guys!
The Insurance company (Privilege) just told us to wait and see what he plans to claim on.

I would have suggested that seeing as there is no damage to either cars, that she denies ever bumping into him and he is just a fraud preying on women. However, you have already admitted to said insurance company, so you should insist on a medical examination by a doctor of your insurance company, proof from his employer that he was booked off sick. She should also counter with the all-time woman favourite trump card - sexual harrasment, she feared for her life as he was very threatening etc... or something like that.

I would just admit the bumping, but would note that no damage was done to the car.
If there is any damage in the car now, just say he might have made it after.
That way, he is the one that should prove your wife made any damage to his car.

oooh insurance companies do all they can to not pay out indeed.. i was knocked off my bike by some tart who was chatting to her kids, werent round a corner but didnt see i was going straight on and tee boned me good and proper....
she addmitted it was her fault and all evidence shows this but el imsurance companies say that a busted bike that has been tee boned isnt proof enough...
im sure youll be ok and they wont pay him a single penny...

He is pulling a variation on the bump and run scam . Most insurance companies are familiar with it and will NOT pay out on such claims. They will in most cases prosecute the people who make such claims. And from the sound of it you have nothing to worry about
